Terms of Service

Article 1 (Purpose)

These Terms of Service (hereinafter referred to as "these Terms") set forth the conditions for using applications, web services, and other services (hereinafter referred to as "the Service") provided by Oct Systems Inc. (hereinafter referred to as "the Company"). Users shall agree to these Terms before using the Service.

Article 2 (Agreement to Terms of Service)

Users cannot use the Service without agreeing to these Terms.
When users use the Service downloaded to their devices, they are deemed to have agreed to these Terms.
Users shall use the Service in accordance with these Terms.

Article 3 (Terms of Use)

The Service is intended for users aged 13 and above. Minors must obtain consent from a parent or legal guardian before use.
Users acknowledge that the Service may not be available unless they comply with specifications set by the Company (including but not limited to supported OS, performance, and functions).
Users are responsible for preparing and maintaining at their own expense the devices, communication equipment, means, and electricity necessary to use the Service.

Article 4 (Prohibited Activities)

Users shall not engage in the following activities when using the Service:

  1. Unauthorized use of the Service or provision of false information
  2. Infringement of third-party rights (including copyrights, trademarks, privacy rights, etc.)
  3. Modification, reverse engineering, or analysis of the Service
  4. Nuisance or harmful activities toward other users
  5. Commercial use of the Service (unless specifically permitted by the Company)
  6. Activities violating laws or public order and morals
  7. Activities deemed inappropriate by the Company

Article 5 (Location Services and Navigation)

  1. The Service provides route guidance using external services such as Google Maps. The provided information is for reference only and may differ from actual traffic conditions, road conditions, and weather conditions.
  2. When traveling according to route guidance provided by the Service, users shall be responsible for confirming actual traffic regulations, road signs, and local conditions, and act with due care for safety.
  3. The Company assumes no responsibility for accidents, injuries, or damages arising from travel according to the Service's route guidance.

Article 6 (User Content)

  1. Regarding images, text, and other content uploaded to the Service by users or businesses (hereinafter referred to as "User Content"), users grant the Company a non-exclusive, royalty-free license to use such content for the following purposes:
    • Provision, operation, and improvement of the Service
    • Advertising, promotion, and PR activities of the Company or the Service
    • Creation and provision of statistical and analytical data to third parties
    • Other purposes deemed necessary by the Company
  2. The Company may process, edit, and reproduce User Content.
  3. Users warrant that User Content does not infringe upon the rights of third parties.
  4. If claims of rights infringement are made by third parties regarding User Content, users shall resolve such matters at their own responsibility and expense.

Article 7 (Limitation of Liability)

  1. Except in cases of willful misconduct or gross negligence by the Company, the Company shall not be liable for any direct or indirect damages (including lost profits, data loss, inability to use, etc.) arising from use of the Service.
  2. The Company assumes no responsibility when the Service is unavailable or information leakage occurs due to force majeure such as natural disasters, system failures, communication line problems, cyber attacks, or unauthorized access.
  3. The Company does not guarantee the completeness, accuracy, or currency of information provided by the Service (including tourist spot information, route information, etc.).
  4. The Service is provided "as is," and the Company makes no warranties, express or implied, regarding fitness for a particular purpose, merchantability, or non-infringement.

Article 8 (Account Management)

Users are responsible for managing their accounts and are prohibited from transferring or lending accounts to third parties.
The Company shall not be liable for damages caused by unauthorized use of account information.

Article 9 (Changes, Suspension, and Termination of Service)

  1. The Company may change the content of the Service or suspend or terminate the Service without prior notice to users.
  2. The Company shall not be liable for damages incurred by users due to changes, suspension, or termination of the Service.

Article 10 (Suspension and Termination of Use)

If users violate these Terms, the Company may suspend accounts or terminate use of the Service without notice to users.

Article 11 (Changes to Terms)

The Company may change these Terms without notice to users.
The latest Terms will be posted on the Company's website, and continued use after posting constitutes consent to the changes.

Article 12 (Communication Methods)

Communications from the Company to users regarding the Service will be made through postings on the Company's website or other methods deemed appropriate by the Company.
Communications from users to the Company regarding the Service shall be made through the "Contact Form" on the Company's website.

Article 13 (Assignment of Rights and Obligations)

If the Company transfers the Service business to a third party (including cases of M&A such as mergers and company splits), the Company may transfer to such third party the rights and obligations under these Terms, contractual status, and information on the Service such as member registration details and customer registration information.
Users are deemed to have agreed in advance to the content of the preceding paragraph.

Article 14 (Language, Governing Law, and Jurisdiction)

The formation, validity, interpretation, and performance of these Terms shall be governed by and construed in accordance with the laws of Japan.
If these Terms are prepared in Japanese and languages other than Japanese, and there are contradictions or discrepancies between the language versions, the Japanese version shall prevail in all respects.
For disputes arising between the Company and users regarding the Service or these Terms, the Tokyo District Court shall be the exclusive court of first instance.

Article 15 (Severability)

Even if any provision of these Terms is determined to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue to be valid.
